Access to and use of this service is provided by subject to the following terms and conditions
 
1. General

1.1 Use of this service constitutes your acceptance of these terms and conditions which take effect from the time you complete the registration form.

1.2 If you do not accept these terms and conditions you must not register to this service.
 
1.3 Holden Pearmain Research Ltd reserves the right to change these terms and conditions at any time by posting changes online and sending out one email to the email address you registered with.
 
1.4 Continued use of this service after such changes to the terms and conditions constitutes acceptance of those posted changes.
 
1.5 Holden Pearmain Research Ltd reserves the right to make this service unavailable at any time without notice.

 

1.6 By completing the registration form you have signed up to the Talk Panel and are regarded as a Panelist.
 
2. Intellectual property
 
2.1 You acknowledge that all intellectual property rights, including any trademarks or copyright in the content of this service, are owned by Holden Pearmain Research Ltd or its clients. Nothing contained herein shall be construed as granting any licence or right to use any of the intellectual property of, except if explicitly stated on this site.
 
2.2 Outside of this service, material may not be copied, reproduced, republished, downloaded, posted, broadcast or transmitted in any way except for your own personal non-commercial use, or in accordance with terms and conditions.
 
3. Subject Information Statement
 
Holden Pearmain Research Ltd processes your personal data (as defined by the Data Protection Act 1998 ("the 1998 Act")) for the following purposes:
 
to keep you informed and obtain your views of products, services and activities;
the creation of a database of individuals willing to take part in research and surveys;
evaluating which individuals registered with the Talk Panel should be approached in respect of surveys being conducted;
to provide you with information about benefits given to you by Holden Pearmain as a result of your responding to survey requests;
processing the answers to surveys and summarising the results;
undertaking research surveys on behalf of third parties;
transferring to service suppliers who undertake processing on our behalf and at our direction;
permitting third party research organisations to question individuals registered with the Talk Panel in respect of surveys;
to provide you with information relating to any benefits provided to you by any third parties, including but not limited to a benefit provided to you by our client in response to your answer to a survey request;
transferring any personal data to any subsidiary or group company;
the administration of your membership of the Talk  Panel;
statutory and regulatory compliance;
to transfer to third parties who provide services to Holden Pearmain for providing benefits to participants in surveys;
contacting you by email to invite you to take part in surveys and when permitted by you, to send you electronic marketing communications keeping you informed about the activities of the Talk Panel 

We may collect personal information from you when you communicate with us by any media.
 
4. Anonymity
 
Holden Pearmain Research Ltd provides clients with data containing anonymous answers to survey questions or a report setting out and interpreting those answers. No personal data in respect of those individuals responding to a survey will be given to clients, without your permission. 
 
5. Obligations to the Panelist
 
For each survey a panelist completes, they will be eligible to take part in a prize draw.  "Survey completion" means answering all survey questions after the original screening questions.  After answering all questions, the panelist will see a screen that shows the information that the survey has been completed.  Holden Pearmain will automatically enter all panelists who completed a survey into the respective prize draw.  The invitation to a survey will always include details about the prizes.       
 
5.1 Holden Pearmain Research Ltd reserves the right to:
 
a) offer a substitute reward of equivalent value to the prize offered initially; and 
 
b) change the value of the Nominated Amount in respect of answering survey and research questions.
 
No cash alternative is available in respect of the payment of the reward.

 

5.2. Prize draw winner(s) will be selected at random from all eligible entries received. Winners will be notified after each draw by e-mail. The prize is awared conditionally upon acceptance and if a winner is unable to be contacted after 28 days or if any prize is unclaimed or declined within 28 days, the prize shall be deemed as unclaimed or unaccepted and a supplementary winner may be drawn at Holden Pearmain's discretion. Prizes are not transferable to another person.
 
6. Obligations of the panelist
 
6.1 The Panelist warrants that they are 16 years old or over;
 
6.2 The Panelist warrants that they are resident in the United Kingdom of Great Britain and Northern Ireland; and
 
6.3 The Panelist warrants that they shall not register with the Talk Panel more than once.
 
6.4 Holden Pearmain Research Ltd has no obligation in respect of any tax due on the Reward given to a Panelist and the Panelist shall be responsible for declaring any income received from the Talk Panel under this Agreement.
 
7. Termination
 
7.1 You can terminate this Agreement at any time by unsubscribing from the Panel; this can be done by email or in writing. The termination will take effect up to 10 business days after the receipt of your notice.  Emails should be sent to talk2us@talkpanel.co.uk and letters may be sent to:

7.2 Holden Pearmain Research Ltd reserves the right to suspend or terminate your access to this site and/or Log-in details at its sole discretion and without notice.
 
8. Liability
 
Holden Pearmain Research Ltd will not be liable for any claims, losses, including but not limited to direct, indirect, special, economic and consequential loss or damage (including but not limited to loss of profits, loss of revenue or loss of goodwill) arising out of or in connection with the use of this service, whether in contract, negligence or other tortuous action.

 
9. Jurisdiction
 
These terms and conditions are governed by and will be interpreted in accordance with English law and the parties submit to the exclusive jurisdiction of the English courts.
